I am writing to you as one of the Petitioners in the case stated above. The purpose of this
letter is to bring to your attention certain details that you may not be privy to with regard to this
Firstly, Sherri Hutton who is one of the Defendants, in this case, was the notary who
notarized the will and testament of my late dad. In the said will she was named as the
Independent Executrix, we suspected her of fraud as the will had indicated two separate dates of
my father’s death. This raised a lot of questions on the accuracy of the will. This prompted us to
seek the services of an expert in handwriting to confirm if the will was indeed made by my
father. The report of the handwriting expert confirmed our suspicion and affirmed that the will
Secondly, we notified our then-Attorney Mr. Osborne to present this fact/ evidence to the
Judge but he ignored or refused to give this evidence to the judge. The handwriting expert had
already made an affidavit to support the claim that the will was forged but Mr. Osborne was
adamant to accept his evidence. One peculiar incident happened in court where the judge asked
Mr. Osborne if there was anything else, he wished to submit to the court and Mr. Osborne
answered in the negative.
It is for this reason that the Petition to Annul the will did not succeed this costed us as a
family and that is why we decided to terminate the services of Osborne as our Attorney. We
filled a Second Petition to Annul the Probate for the court to address the issue of forgery and
form of the will.
I will be moving the matter pro se because I have a keen interest in the matter and also
the previous attorneys, we have engaged were not keen to pursue the matter or rather they did not
follow our instructions as clients. Therefore, I see it fit to pursue the matter and make sure that
we get justice.
