This agreement is to inform you of Elder Care Channel’s policies and the type of service
you will be receiving. Please read the following items carefully. If you do not agree with the
terms of this contract, do not use the service and immediately contact Constant
Companions Home Care at ______________.
The terms and conditions set out below constitute an agreement (“Agreement”) between
ElderCareChannel.Com (“Company”) and the Employing Customer (“Purchaser”) and/or the
recipient of care services (“Customer”).
1. TERM OF AGREEMENT.
The term of this agreement commences on the Effective Date, and continues until the Agreement
is terminated by either party, as provided hereunder.
Services: Agency provides services requested by Client as set forth in the attached Care Plan,
which may be modified from time to time at the request of Client or Agency. The preferred day,
time and duration of services are mutually agreed upon by Client and Agency.
Rates, Fees & Deposits: Agency will provide the services at the rates set out in the attached
Billing, Payment, and Overdue Accounts: Agency submits invoices to Client twice per month,
payable on receipt. Payment may be made by credit card.
An account is considered overdue if not paid within 10 days of the billing date. Interest will be
charged on balances which remain unpaid for 30 days or more, subject to 7 % interest per month
on all outstanding balances, until paid in full.
Agency reserves the right to suspend or discontinue services until the account is paid in full.
3.1. By signing this agreement, you understand that you will financially responsible
for any and all charges incurred in the event that your account is sent to collections
including all court costs and attorney fees. Prices are subject to change with a written two
(2) months’ notice from Constant Companions Home Care. At such time an addendum
altering original pricing will be attached to this original contract.
3.2. The Company’s charges for the provision of care services by its employees (the
“Carers”) and these will be notified to the Purchaser and/or Customer before the
commencement of such services, or otherwise will be posted on our website.
3.3. Any special charges or terms agreed with the Purchaser will be confirmed, in
writing, by an authorized representative of the Company and in the absence of such
written confirmation; it will be assumed that no special charges or terms exist.
3.4. Any subsequent amendments to the Company’s scale of Standard Rates will be
notified, in writing, to the Purchaser and//or Customer. The Company reserves the right,
at its absolute discretion, to review its charges at annual or any other interval.
3.5. If Customers pay on a daily or hourly basis, all government Holidays are charged
at double the standard rate quoted by the Company plus up to four additional days over
the Thanksgiving, Christmas and New Year period in any year will be charged at one and
a half times the Standard Rate given by the Company at any time.
3.6. The Company reserves the right to charge an enhanced hourly rate when Carers
working outside our normal hours, (such as overnight.)
3.7. Where the care service is to be provided for a period of 4 weeks or less, the
Company will require a pre-payment (for the full period or as agreed by the Company)
which will include a short-term care fee, unless a short-term promotion is offered.
3.8. ElderCareChannel charges time and one-half for the following holidays: New
Year’s Day, Easter Sunday, Memorial Day, Fourth of July, Labor Day, Thanksgiving
Day, and Christmas Day.
3.9. If you dispute charges on your bill, you must notify ElderCareChannel.Com
immediately upon receipt of said bill and no later than one week of the date on the bill or
else you waive the dispute.
3.10. Client/Conservator/Customer agrees to pay in advance a deposit in the amount of
two (2) weeks of agreed-upon service, to be noted at the end of this document. This
deposit will be held in a secured account and returned to the Client/Conservator at
termination of services or in lieu of the final bill.
4.1. The only method of payment we accept is by credit card for the service provided.
Payment must be received prior to the care and support being put in place.
4.2. The Company reserves the right to charge interest at 7% above the applicable
prime rate on any sums outstanding 28 days after the date of invoice. Interest so charged
will be calculated on a daily basis on the total amount outstanding until such time as the
amount overdue is paid.
4.3. The Company will give the Purchaser and/or Customer 7 days’ notice, in writing,
of its intention to charge such interest. The Company also reserves the right, upon written
notice of 7 days, to terminate the introduction of Carers in the event of continued
nonpayment, or delayed payment, of invoice(s).
4.4. After the 28 days credit period is over, chasing letters and any subsequent letters
for the payment of the outstanding sums will be sent and the Company reserves the right
to charge for any reasonable costs incurred in taking steps to obtain payment.
4.5. EldercareChannel invoices are due and payable upon RECEIPT. Invoices are
processed and mailed bi-weekly, based on signed timesheets submitted to the office by
the caregiver/companion(s) or by agreement per contract, or to be billed automatically by
credit card as so designated by agreement.
4.6. There will be a $25.00 late fee applied per invoice not received within two weeks
of the date of each invoice.
4.7. The Client/Customer must call ElderCareChannel.com immediately to resolve
any billing issues to prevent interruption of services.
5.1. The minimum contract period for the service that the Company provides is two
weeks which will be charged regardless of whether the service is required or not.
5.2. The Company reserves the right to charge the Purchaser and/or Customer a
cancellation fee equivalent to the cost of one week’s service, at the Standard Rate
applying from time to time, should the Purchaser and/or Customer give less than one
week’s notice of their desire to cancel an assignment for which the provision of Carers
has already been agreed with the Company.
5.3. Hourly charged care services that are cancelled with less than 24 hours’ notice
will be charged in full.
5.4. If care is cancelled by the Purchaser within 24 hours of an agreed start date, the
Company reserves the right to charge a 72-hour cancellation fee.
6.1. The Company reserves the right to charge the Purchaser and/or Customer it’s
normal Standard Rate charges for a period, of up to, but not exceeding, 1 week, if less
than 1 weeks’ notice is given of the Purchaser’s and/or Customer’s desire to terminate a
Live-In assignment (bereavement, hospitalization or transfer to a Nursing or Residential
6.2. The Company also reserves the right to terminate the service forthwith without
notice if the Company’s service contract and direct debit authority is not signed and
returned within 7 working days of the commencement of the care service provided.
6.3. In circumstances where the Company reasonably perceives a significant risk of
harm to a Carer, it may give immediate notice terminating the service and this
Agreement. The company reserves the right to give notice of one week if the Health and
Safety of those involved in the care and support is compromised. To fulfil this notice
period the Company may need to insist on additional measures to enable this to occur
6.4. Both parties have the right to terminate services at any time with a 24-hour notice.
The agency has grounds for immediate cancellation of services if: Client refuses
necessary observation, demonstrates abuse or being abused, demonstrates neglect,
demonstrates inadequate clothing/food noted by the caregiver for proper care, unhealthy
and/or unsafe environment or non-payment of services.
7. CONFLICT RESOLUTION.
In case of direct or indirect evidence of abuse or even suspicion of being abused,
ElderCareChannel.Com is required to report this to the police closest to the customer; this
emergency number must be provided by the client.
8. CONSENT FOR SERVICE.
By signing this Agreement, Client hereby consents to receive in-home non-medical services as
outlined in the Agency’s attached Care Plan. Any representative acting on behalf of the Client by
signing this Agreement warrants that they have the legal right and power to do so by initialing
the Agreement here: [_______].
Client provides as part of this agreement, emergency contact information.
Agency verifies the contact and then uses that information only if necessary.
Client is required to notify Agency of any changes to contact information.
10. LIMITED LIABILITY.
10.1. The Carer/caregiver/companion is not a licensed nurse, therefore is not liable for
any medical advice. Eldercarechannel.com is NOT liable for any falls that occur for the
client, nor any medical procedures, such as resuscitation, nor will be held liable for any
omissions such as providing any medical advice or calling emergency services.
10.2. All medications must be pre-measured and/or pre-poured by a family member or
licensed nurse. Carers/caregivers of Eldercarechannel.com and the
Eldercarechannel.com will not be held liable, though they may provide reminders to take
medication in general, such as to take medication at certain times, but will not discuss
amounts of any specific medication. They will not be held liable for any errors through
these timely reminders.
10.3. If Eldercarechannel.com provides exercises and physical training lessons to
clients, it will not be held liable/responsible for any injury or medical emergency incurred
due to the training. All clients and anyone else observing such exercise lessons are
expressly advised to get permission from their physicians before taking part in any such
10.4. Eldercarechannel.com is not responsible should a client be out of the field of view
of the caregiver who provides internet surveillance, and injury or death occur, for
example, due to a fall.
11. GOVERNING LAW AND JURISDICTION.
These terms and conditions will be governed by and construed in accordance with ___________
[State/Country]. Both parties agree that any litigation arising out of this agreement shall be
commenced at the designated to the court with the jurisdiction within _______________
ElderCareChannel.Com may revise these terms and conditions from time-to-time. Revised terms
and conditions will apply to the use of this Website from date of the publication of the revised
terms and conditions on this Website.
13. ENTIRE AGREEMENT.
These Terms and Conditions together with other legal documents bay the Company constitute
the entire agreement between you and ElderCareChannel.Com in relation with your use of this
website and services offered.
