Shipping Purchased Items
Kook will not be held responsible for fluctuations in the cost of shipping, and you will not be reimbursed for discrepancies between calculated shipping costs and the actual shipping costs.
Responsibility for Taxes
You shall comply with all applicable domestic and international laws, statutes, ordinances and regulations regarding your use of the website and, if applicable, your listing, purchase and sale of items. In addition, you shall be responsible for paying any and all taxes applicable to any purchases or sales of items you make on the website. This includes sales taxes applicable in each state, depending on the threshold required for collection. Kook is not responsible, in any manner, for paying taxes on your earnings or your use of the website.
You agree not to use this site for unlawful purposes or in an unlawful manner. You agree to comply with all applicable local, state and international laws, statutes and regulations regarding use of the site. You agree not to use or permit any one to use information provided through the site for any unlawful or unauthorized purpose. You agree not to register under a false name or use an invalid or unauthorized credit card.
The sale of stolen property on Kook and all partner websites is strictly forbidden, and violates state federal and international law. Kook strongly supports law enforcement efforts to recover stolen property that is listed on its site, and urges the prosecution of those responsible for knowingly attempting to sell such items on Kook. Stolen property includes items taken from private individuals, as well as property taken without authorization from companies or governments.
We may investigate complaints and violations of our policies. You agree to cooperate fully with such investigations, including without limitation, providing us specific information regarding your right to a good, the source of a good, your acquisition of a good, or the price you paid for a good.
Violations, Termination and Suspension
We may take any action that we deem appropriate in our sole discretion, including without limitation issuing warnings, a warning, or suspension or termination of service, denying access, and removal of listings of items from, or recommending you edit a listing if: (a) you breach this Agreement or the documents it incorporates by reference; (b) you are unwilling to cooperate with our investigation of a complaint or reported violation; (c) we are unable to verify or authenticate any information you provide; (d) or we believe your conduct may cause legal liability for you, for other members, or for Kook. You agree that payments owing to you for sales made through this site may be suspended or delayed pending our investigation. Kook is not obligated to pay you for any sales if we have a good faith basis to believe such sales were unlawful or otherwise made in material violation of this agreement.
Disclosure of Information
Your Warranties To Us
You represent and warrant that any information you provide to us, to other members, or to visitors (a) is not false, inaccurate, misleading, obscene or defamatory; (ii) is not fraudulent; (iii) does not involve the sale of counterfeit or stolen items; (iv) does not infringe any third party’s copyright, patent, trademark, trade secret, rights of publicity or privacy, or other right; (v) does not violate any law, statute, ordinance or regulation, including without limitation those governing consumer protection, unfair competition, anti-discrimination or false advertising; and, (vi) does not contain any viruses or any programming that is intended to damage or interfere with any system, data or personal information.
You agree to indemnify and hold Kook, and its parent (if applicable), subsidiaries, affiliates, partners (online or offline), officers, directors, attorneys, agents and employees, harmless against all liabilities, costs and expenses (including reasonable attorneys’ fees) incurred by Kook, and its parent (if applicable), subsidiaries, affiliates, officers, directors, agents, attorneys and employees that arise out of any claim asserted by a third party that involves, relates to or concerns any of your actions or omissions.
To place an order you can either open an account with us. If opening an account with Kook, you will be required to provide us with some compulsory personal information.
You confirm that all personal information provided to us by you is accurate, true to your knowledge, and kept up to date. You can, at any time, update or correct your details by logging in to your Account.
When you create an account we will ask you to create a password to allow you to access your account, and to maintain account security on this website. You are responsible for keeping your password and account information confidential.
We shall not be liable for any loss or damage which may arise as a result of any failure by you to protect your personal information. Should you become aware of or suspect any unauthorized use of your account, please contact us.
If we are suspicious of any activity from your account that appears fraudulent, we can reserve the right to refuse you access to, and where necessary, delete your account.
Completion of checkout online does not constitute our acceptance of your order from us. You will be notified by email as soon as possible with confirmation that we are processing your order. Our acceptance of your order will take place only when we take payment from you and dispatch of the product(s) is confirmed.
We have the right, prior to dispatching the product(s) to decline an order for any reason, including legal and regulatory reasons.
Our contract with you will start when you receive the order dispatch email and remain in place until the last day of your right to return the products.
If we cannot supply you with the all of the products you ordered, we will not process the parts of your order unavailable. We will inform you of this by email and, if you have already paid for the product(s), refund you in full for the item(s) as soon as reasonably possible.
If the fulfillment of any aspect of an order would be illegal or unlawful, we have the right to stop or cease to fulfill the order at any time, including after dispatch of products or notification to you that the order is being processed. In such circumstances, you acknowledge that Kook shall incur no liability.
We take payment from your card at the time we receive your order, once we have checked your card details and stock availability. Goods are subject to availability. In the event that we are unable to supply the goods, we will inform you of this as soon as possible.
To ensure that your credit, debit or charge card is not being used without your consent, we will validate name, address and other personal information supplied by you during the order process against appropriate third party databases. By accepting these terms and conditions you consent to such checks being made.

If any provision of these disclaimers and exclusions shall be unlawful, void or for any reason unenforceable then that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.
Subject to the provisions hereof, you shall indemnify, defend and hold harmless from and against any and all amounts payable under any judgment, verdict, court order or settlement for third party claims brought against Kook and its licensors arising from services related to these Terms and Conditions.

Gear Rental Policies & Fees
Rentee should be 18 years of age or represented by an adult. A valid ID is required to be presented and scanned of the rentee (i.e. Emirates ID…) A refundable deposit of AED 250 to be paid at the beginning of each rental. This amount will be refunded once the rented items are returned to Kook.
To receive a full refund, reservations must be canceled by 10 PM Dubai time on the day before the reservation start date. Cancellations made later than that will be charged for the first night of all items in the reservation. To cancel a reservation, customers must call Kook on WhatsApp: +971 56 1050859.
Rentals returned earlier than the due date/time will not receive refunds for any unused days/time.
Late returns will be charged a one-time late fee of AED 75, plus the first-night rental price for each additional night the gear is late. For example, if you are more than an hour late returning your tent, you will be charged AED 20 + AED 75, for a total late fee of AED 95.
For items returned excessively wet or dirty, a cleaning fee could be assessed. The cleaning fee is either AED 75 or the first night rental rate, whichever is less.
If gear is damaged beyond normal wear and tear, we reserve the right to charge normal shop rates for repair. If gear is damaged beyond repair, the customer will be charged the full retail price less the rental fee.
For any items that are not returned, Kook reserves the right to charge up to the full retail value, less the rental fees already paid.

Is there a ½ day rental option
No, a one-night (24 hrs) rental is our minimum rental period. That includes the time for pickup and time to drop-off.
How I use my rental gear?
All gear pages include a how to video. But, we highly encourage you to connect with a Kook employee while picking up your gear. If you don’t have time to connect with a Kook employee, there’s a lot of great guidance in our gear pages by scanning the QR codes on the gear that will take you to the gear usage page online. The contract between us and you shall be governed by the laws of United Arab Emirates and any dispute between us will be resolved exclusively in the courts of United Arab Emirates.
You and Kooks concur that it is our goal that these Terms and Conditions be enforceable as per their terms to the furthest reaches allowed by law. You and Kooks concur that if any segment of these Terms and Conditions are declared by a court or referee to be invalid or unenforceable, that mediation won’t nullify the rest of these Terms and Conditions and they will be completely enforceable.
To the degree allowed by material law, these Terms and Conditions express all terms concurred by the gatherings and override all different arrangements by the gatherings identifying with its topic.
