Colorado restaurant Vs the government of the United States of America
Kent Vs Dulles (1958)
The issue of Meyre Vs Nebraska
The COVID-19 Act of 2020.
At the break of COVID 19, every nation tried as much to contain the deadly virus .perhaps most of the measures in place were to prevent the further spread into the communities. Children and adults are the most vulnerable group. However, everyone is at risk of contracting the virus as revelled by world health organization (WHO). Never the less some of the proposals that have been passed into laws were not correctly done. The reason being that the implementers of the constitutional rights did not consider the implications it could cause to the lives of the Americans. The government is obligated to safeguard the civil, economic, cultural as well as the political rights of its citizens .respect to the human rights should be observed t all the stages of implementation of COVID 19 restrictions. In this essay I would discuss some of the restricts placed on the people living in the united states of America during the COVID 19 period would also tackle some of the implications of the COVID 19 acts on the rights and freedoms of the American’s.
A state can choose to prevent citizens from moving in and out of the country. Such actions can affect individuals’ rights, either positively or negatively. For instance, when Americans are deprived of the right to move from one part of the United States of America to another. Ideally, such deprivation of ownership has led to many cases in the United States courts. Generally, many of the American citizens have been complaining about the restrictions placed during the Covid19 pandemic, for instance, in the case of Coronado restaurant Vs the government of the United States of America. During the time of COVID 19, many other countries in the world have placed measures such as closing their borders to help in controlling the spread of COVID 19. However, actions such as closing borders have hindered citizens from getting together with their families. According to the research, some American citizens have also filed cases against the American government. Some of the citizens have been complaining that the set rules and regulations have deprived them their rights to movement in that they cannot even attend schools and business like before. Surprisingly the measures placed by different laws made during the COVID-19 has helped to contain the spread of covid19. Organizations such as the World Health Organization (WHO) also sidelines with the restrictions set by the American government, such as travel ban since they are very vital in controlling the spread of
About ICCPR individuals, the movement might be restricted to exceptional circumstances such as COVID-19. An individual can be deprived of the freedom of movement, as stated in the constitution of the United States of America in the COVID-19 Act 2020. The law requires that all the restrictions on travelling must be put in place per the intended obligations of ICCPR. Some of the principles of ICCPR that should be checked upon include ensuring that the restriction is not discriminatory, legitimate, and not very restrictive with alternative given as well as being proportionate.
Article 19 of the American constitution, individuals rights to get and impact information are protected. Ideally, such restrictions can only be affected in particular circumstances. Some of the cases include situations whereby the health of the general public is prioritized. However, in situations whereby such demands are not followed to the latter alternatives described in Article 19 of the American constitution may apply. Some information, such as education on diseases such as covid19 may also be issued to the citizens. This may include methods of controlling and preventing diseases such as COVID-19. Such information is useful since they help individuals to achieve their constitutional right to health.
Besides, transparency and censorship play a significant role in ensuring that medical care reaches the needy. This is done through containing the spread of diseases such as coronavirus effectively. Even though the strategy works well on situations whereby members of the public are provided by all the relevant information concerning the communities which are affected by the virus, such information helps members of the community to understand nature of the crisis. In partnership with the local authority participation of the city can be done in situations whereby the government and the community do not take such measures, the strategy becomes unsuccessful. Moreover, in such cases, an individual’s rights may be violated since their lives are at risk.
Every individual in the United States is expected by the law to participate actively in measures placed to control, prevent and treat the spread of the epidemic. About the law, the government is mandated to ensure that all the goods that may be used in the process of preventing and care of COVID-19 patients are availed to every individual at affordable prices. The government is supposed to ensure products for taking care of covid19 patients are distributed equally to every part of the United States of America. The law also demands the American government through the ministry of health to provide right accurate information as far as the behaviour of the virus is concerned. Some of the preventive and care goods may include hand sanitizers and face masks. According to research, not all the families are in apposition to afford the protective gears used such as face masks. Such a group of people are marginalized since they cannot even afford such an important commodity. Besides, such a vulnerable group of people may find themselves exposed to the deadly virus due to the lack of protective gears. Being that many governments are in a position to subsidize the cost of these commodities, the American government should avail free face masks to needy families to help with the reduction of the spread of the virus.
About research carried out by the World Health Organization (WHO) people with pre-existing conditions such as diabetes, asthma, and the old, as well as children, are more vulnerable to the deadly disease. The research also shows that people with weak conditions have experienced the highest number of deaths. According to the World Health Organization (WHO), the study also reveals that the vulnerable group is majorly affected by the disease since they have a low immune system. Therefore the government of the United States of America came up with an age limit for persons to be allowed to attend social functions such as prayers and burials. However, such restrictions have turned out to be against an individual’s constitutional rights to worship as claimed by several people in the United States. Being that women always play a significant role in providing care to members of their families, it is essential to note that they are also exposed to the virus in the process of fulfilling these kinds of needs. For instance, girls may be left to take care of children at home; unfortunately, the girl might be at high risk of contracting the deadly virus from the child she is babysitting. Different cases have been filed in the American courts on the claim that women’s rights have been defiled especially by the demands of COVID-19 restrictions. Women and children should be categorized under the vulnerable group and be given basic needs such as products needed during pregnancies and menstrual periods.
During the hard times of COVID-19, the government has placed measures such as restrictions of movement, the introduction of curfew hours as well as quarantines. The government also placed a ban on public gathering. Rights of individuals have been greatly affected by such laws the reason being that. Workers are unable to move to and from their workplaces due to restrictions placed by the government. Casual workers are the most affected due to the limits set by the government. The government law interferes with individuals’ right of movement; hence the causal workers are unable to go to work. Usually, the casual workers always have other benefits related to work such as bonuses and even holidays. They are the most affected group since they live a life of hand to mouth and remain with almost nothing to save in hard times, such as the time for COVID-19. Last most of the workers are not entitled to most benefits such as hospital medical cover which could come into their rescue during challenging times such as COVID-19.
In the due process of prevention COVID-19, some people have been discriminated and stigmatized in countries such as China. Such stigmatization has seen a reduction in profits in hotels owned by Chinese in countries such as the United States. Moreover, people from the Middle East have been harassed since the time of COVID-19 outbreak due to the perception that they are the source of coronavirus some of such actions have been done by racists hence causing them physical injuries. Organizations such as the World Health Organization (WHO) carried out research that revealed the shortcomings related to stigmatization and health of the public. According to the study carried out, people may opt to remain silent with their sickness to avoid stigmatization and discrimination by members of the community. Again research centres in the United States of America did their research on stigmatization as it is the source of fear and anger people that are ordinary. According to the law, the government is obligated to ensure that measures placed to reduce stigmatization and discrimination are put in place in all sectors.
The lives of health care workers should be put into consideration when implementing laws. Health care workers are categorized under the front line workers in the fight against COVID-19. The reason being most of the health care workers take reasonable risks to their families in the fight daily against civil-19. There are many risks related to the battle of a pandemic which may include distress, long working hours and fatigue. Researchers revealed that in China, over three thousand health care workers had contracted COVID-19. With the high number, it is a clear indication that the demands of the constitution were not followed promptly in the fight against COVID-19.
In many countries, orders had been issued concerning an individual’s movement, for instance, in some countries presidents were told not to leave the country unless they were falling under the exempted category. Some countries instructed their travellers to be under self-quarantine for fourteen days. Some businesses which are non-essential such as the sale of alcoholic drinks were closed. In due course, the unemployment rate increased by about 14.7% in the United States. This was the highest increase in the unemployment rate since independence. Some of the laws that affect constitutional rights of individuals have experienced in the United States of America such the case of Kent Vs Dulles (1958).During the case the Supreme Court judged that shrimping act was provided by the fourteen amendments. In the case of Meyer Vs Nebraska, it was determined that liberty was protected by the constitution.
